DEFINITIONS
"Booking"
|
means reservation for a room or rooms at the Participating Hotel(s) made by a Member
in accordance with Clause D(1). |
“CHM Club” |
means the membership program that entitles a Member the right to earn Points, which
can be redeemed for Rewards in accordance with the terms and conditions hereinafter
set out and as may be revised from time to time by the Company at its sole and
absolute discretion. |
“Company” |
means Cititel Hotel Management Sdn Bhd [Company No.199001006532 (198102-W)] |
“Member”
|
means an individual who is 18 years old and above, who enrolled for the CHM Club and
accepted by the Company as a member. |
“Participating Hotel(s)”
|
means the hotels managed by the Company in Malaysia and which participate in the CHM
Club including but not limited to the following:-

“Points” |
means the points earned and accrued by a Member in accordance
with Clause D. |
“Qualifying Room Rate” |
means the room rates of the Participating Hotel(s) published in the Participating
Hotel(s)’ respective website, including but not limited to the Best Available
Rate, Rack Rates, Promotional Rates, Corporate Rate, Long Stay Rate and such other
hotel packages and/or room rates stated in the respective website(s). |
“Qualifying Year” |
means a period of twelve (12) months commencing from the date of a Member’s
first Stay that qualified as an Eligible Room Night for determination of the
Member’s Membership tier in Clause C(3). |
“Stay” |
means the number of night(s) spent at the Participating Hotel(s), whether by the
Member as a staying guest or otherwise, and complies with the requirements
in Clause D(8). |
Eligible Room Night |
means an overnight stay at any Participating Hotels under Qualifying Room Rate. |
B. GENERAL

The CHM Club membership (“Membership”) and its benefits are
offered by the Company at its sole and absolute discretion to the Members and reserves the
right to accept or refuse a Member without assigning any reasons thereto. Corporations,
associations or groups are not eligible to enrol in the CHM Club.

Upon successful enrolment, Members are entitled to earn Points from Bookings and/or for
Stays that complies with the requirements in Clause D(1) and the
accumulated Points may be redeemed for the rewards/benefits in accordance with
Clause H hereunder.

A Membership number will be allocated to each Member and the Membership number has to be
quoted, unless otherwise provided in these terms and conditions or agreed by the Company,
upon making a Booking or before check-out as a staying guest at the Participating Hotel(s).

The Points and Eligible Room Nights shall at all times remain the property of the Company
and the Membership and accrued Points or Eligible Room Nights are non-transferable. The
accrued Points, Eligible Room Nights and/or rewards are for the benefit of the Members only
and the Members warrant, covenant and undertake not to sell, trade, exchange, barter or in
deal with the accrued Points, Eligible Room Nights and/or rewards in any manner other than
as provided in these terms and conditions.

Each Member warrants and undertakes that all information provided by the Member for the
Membership is true, correct and accurate at all times and shall as soon as reasonable,
update any changes to the information provided.

The Company shall not be responsible for any failure or inability of the Member in accessing
its Membership account and/or to make a redemption of the Points and/or resulting in
deactivation of his/her account or forfeiture of Points arising from a default or
non-compliance by a Member of the terms and conditions of the CHM Club or by reasons not due
to the Company’s acts or omission.

The Company, shall without prejudice to its rights at law including any criminal
prosecution, be entitled to suspend, cancel and/or discontinue a Membership’s rights
and benefits, including but not limited to blocked access to the Member’s account
and/or redemption of Points and/or forfeiture of Points, if the Company has reasonable
grounds to believe that a Member has: (i) acted in a manner inconsistent with applicable
laws or regulations; (ii) acted in a manner inconsistent with, breached or violated any of
these terms and conditions; (iii) engaged in any fraudulent, dishonest or deceptive, abusive
or hostile conduct, (iv) committed theft or any other wrongdoing in connection with his/her
Membership account and/or Points or other benefits provided to the Member; or (iv) failed or
refused to pay any outstanding amount due and payable to the Company or any of the
Participating Hotel(s).

The Company reserves the right to modify the CHM Club structure, benefits, terms and
conditions and other features of the CHM Club for eg. conditions for earning, redeeming, use
or continued availability of the Points, or to discontinue the CHM Club at any time, with or
without notice and it shall be the Members’ responsibility to keep themselves
up-to-date in respect of the CHM Club and applicable terms and conditions. A Member’s
continued access or activities in relation to his/her Membership account, will be deemed as
the Member’s acknowledgment and acceptance of all the terms and conditions and
decision of the Company in relation to the CHM Club. The Company shall not at any time be
liable in any way whatsoever for any loss or damage suffered by the Member resulting from
the amendments hereto.

A Member may at any time check his/her Points, Bonus Points, Eligible Room Nights, status of
Membership and any other benefits by logging into his/her Membership account via the
Company’s website [www.chmclub.com].

A Member acknowledges and agrees that notwithstanding the Points, benefits, stays and
rewards accorded to a Member, redemption or utilisation of such Points, benefits, stays and
rewards are subject to the availability of the goods and services and applicable rules and
regulations of each Participating Hotel(s), including but not limited to any
“black-out” period for room reservations, determined by the respective
Participating Hotel(s).

If a Member requires any clarification or further information or any rectification to
his/her Membership account arising from technical or manifest error (not due to the
Member’s acts or omission) with regards to these terms and conditions, CHM Club,
Bookings, the Points or any other rights or benefits of the Member, the Member may contact
email to customerservice@chmclub.com.
C. MEMBERSHIP

Membership enrolment can be made online at the CHM Club website [www.chmclub.com] or at any
one of the Participating Hotel(s). However, to be eligible to earn the Points, the applicant
must be successfully enrolled as a Member before checking out from the Participating
Hotel(s) and satisfies the conditions specified in Clause D.

A Member may only hold one Membership account at any one time. If a Member inadvertently
creates a duplicate or multiple accounts, the Company shall at its sole and absolute
discretion, merge and consolidate the details of the Member into any one of the accounts
created. The Member shall not have any rights to claim any loss or shortfall in the accrued
Points arising from the consolidated accounts. Where such duplication or multiple accounts
are found to be created by reason of the Member’s actions set out in Clause
B(7) above, the accounts shall be dealt with by the Company in the manner
provided therein.

Based on the Eligible Room Nights earned by a Member in accordance with Clause
E, a Member may be classified as a Basic, Preferred or Elite Member and enjoy
the benefits and rewards as follows:-

To maintain a Membership, a Member must do one of the following activities within every 24
consecutive month period from the date of enrolment:-
-
make a Booking in accordance with Clause D(1); OR
-
Stay at one of the Participating Hotel(s) in accordance with Clause D(8);
failing which the Membership account shall be deemed inactive and the Company shall be entitled
to deactivate the Membership account and forfeit all Points accrued therein (if any).

A Member may at any time cancel and discontinue his/her Membership by giving a written
notice to the Company or delete his/her Membership account from CHM website
[www.chmclub.com]. All Points must be redeemed before cancellation of Membership failing
which, all the Points accrued up to the date of termination/cancellation/deletion shall be
deemed forfeited and Membership account shall forthwith be deactivated.

A Membership will end automatically upon the death of a Member and all Points accrued up to
the date of termination (if any) shall immediately be null and void and the Membership
account deactivated.
D. POINTS
-
Booking
A Member may make one or more reservation for room(s) at the Participating Hotel(s) and cancel
the reservation or any one thereof in accordance with the terms and conditions of the respective
Participating Hotel(s) without any penalty. However, a Member is only eligible to earn Points or
other benefits under the CHM Club if :-
(a) the reservation for the room(s) is/are made at the Qualifying Room Rates;
(b) the same email address must be used for both CHM Club membership
registration and the bookings;
(c) the reservation is not cancelled prior to check-in date; and
(d) the room(s) charges (including any related expenses) are fully settled at
the point of reservation or before the staying guest(s) check out from the relevant
Participating Hotel(s).
A Booking for purposes of the CHM Club, must satisfy conditions stated in (a) – (d) above.

The Member need not be a staying guest or be present at the point of check-in and check-out
by the staying guest or it was a “no-show” event, so long as the requirements
stated in Clause 1(a) – (d) above are complied with, the Points will
be credited into the Member’s account in accordance with Clause D(3)
below.

Two (2) Points are earned for every Ringgit Malaysia One (RM1.00) only spend at Qualifying
Room Rate ie payment for room(s) only and exclude all applicable taxes, service charges and
other spending at the Participating Hotel(s) and will be credited (whether earned via a
Booking or Stay, within five [5] working days after the check-out date.
Bookings made in foreign currencies will be converted into Ringgit Malaysia at such
conversion rate as may be determined by the Company at its sole and absolute discretion for
the purpose of Point calculation.

Notwithstanding the above, additional Points (“Bonus Points”)
may be earned for Bookings made during promotional events/campaigns held by the Company from
time to time.

Bonus Points will be credited into a Member’s account within 3 weeks after the end of
the relevant promotion period or as provided in the terms and conditions of the said
promotion.
-
Points or Bonus Points will only be credited into the Member’s account based on the
Membership number quoted in the Booking regardless whether the staying guest or guests
is/are also a Member or that payment for the Booking was made by the staying guest(s).

If the Membership number was not stated when the Booking was made and the Member stays in
the Participating Hotel(s) as a guest, the Member is still eligible to earn the Points or
Bonus Points by informing the front desk of his/her Membership number at any time before
check-out and all expenses in relation to the room(s) are settled.

Stay
-
If a staying guest is not a Member, he/she is still eligible to earn the Points or
Bonus Points, if :- (a) he/she enrols as a Member of the CHM Club at the front desk
of the Participating Hotel(s) prior to check-out; (b) the room(s) were reserved
under Qualifying Room Rate; and (c) the room(s) charges (including any related
expenses) are fully settled prior to check-out. No Points whatsoever will be awarded
to a staying guest for the relevant stay if he/she enrols only after he/she checks
out from the Participating Hotel(s)

The Points are valid for twenty four (24) months from the Points issuance date or such other
date as may be indicated in the Member’s account. Bonus Points will be subject to the
terms and conditions of the relevant promotional events/campaigns.

Points are available for redemption as soon as they are credited into a Member’s
account.
-
Points once expired or forfeited will not be reinstated.
E. ELIGIBLE ROOM NIGHTS
-
A Member is entitled to one (1) Eligible Room Night for each night of Stay at the
Participating Hotel(s) or each night reserved under a Booking and his/her accumulated
Eligible Room Nights per each Qualifying Year will determine the Member’s Membership
tier and the specific benefits accorded to the different Memberships stated in
Clause C(3).

Eligible Room Night excludes all stay at Participating Hotel(s) that are redeemed by a
Member in relation to his/her Birthday Reward.
-
Based on the number of Eligible Room Nights accumulated on the anniversary date of the
Qualifying Year, the Membership tier will be adjusted (if applicable) accordingly.
F. MEMBER’S DISCOUNT
-
A Member is eligible for a discount on his/her Booking make through CHM Club website
[www.chmclub.com] and the amount of discount will be in accordance with his/her
Membership tier set out in Clause C(3).
-
The discount will apply automatically once a Member logs into his/her Membership account.
-
The member's discount is only applicable to room types displayed on the CHM Club website
at the time the booking is made.
-
Member's discount is not valid with other on-going promotions.
G. BIRTHDAY REWARDS
-
Birthday Rewards will email to the Member two (2) months prior to his/her birthday month,
e.g. if a Member’s birthday falls on 15th April, he/she will receive the
Birthday Reward via email on 1st February. The Birthday Reward is a discounted (for
Basic & Elite Member) or complimentary (for Preferred Member) stay at selected
Participating Hotel(s), Bookings must be via to CHM Club website at least one (1) month
prior to the expiry date stated for the Birthday Reward and the stay completed before the
expiry date stated for the Birthday Reward.

The Birthday Reward issued will be based on Member's current status at the time of
issuance. No additional or revised Birthday Reward will be provided if the Member's tier
is upgraded or downgraded after the voucher has been sent.

Each Member is entitle for only one (1) Birthday Reward per calendar year.

The Birthday Reward is strictly for the benefit and enjoyment of the Member and in the event
of a complimentary stay, if a Member is found not to be a staying guest, the Birthday Reward
will immediately be considered null and void and the relevant Participating Hotel may impose
a walk-in rate for the said room and be fully payable by the Member. Failure or refusal by a
Member to settle the price or charges incurred for his/her stay, will be tantamount to a
breach of these terms and conditions and the Company shall be entitled to exercise its
rights under Clause B(7).

The Birthday Reward is non-refundable, non-transferable, cannot be exchanged for cash,
points or other benefits.

The Birthday Reward cannot be used in conjunction with any other discounts or promotional
offers.

Other terms and conditions governing the use of Birthday Rewards apply.
H. POINTS REDEMPTION
-
The catalogue of items/rewards for redemption of points can be found in the Company’s
website [www.chmclub.com].
-
The Member must have sufficient Points in his/her Membership account to redeem the
particular reward of his/her choice.
-
When a Member makes a redemption, the corresponding number of Points will be automatically
deducted from the Member’s Membership account upon completing the redemption
transaction and the relevant reward redeemed can be viewed in the Membership account.
-
Redemption must be made online at the Company’s website [www.chmclub.com] only and the
reward must be claimed before expiry date and terms and conditions applicable to the reward.
-
Rewards may not be combined with any other offers, discounts or promotions unless
specifically permitted by the Company.
-
Upon completion of the redemption transaction, all goods and services redeemed are
non-negotiable, commissionable, exchangeable for cash nor can it be re-instated.
-
Where a Member intends to redeem his/her Points for stay at the Participating Hotel(s),
whether for the Member himself/herself or otherwise, the redemption must be made at least
one (1) day in advance prior to the intended check in date through the Company’s
website [www.chmclub.com], subject to availability and the terms and conditions for
redemption.

Upon completion of redemption transaction, the Points cannot be reinstated in the
event of a no-show or cancellation.
-
Stay at a Participating Hotel by way of redemption of Points only, will not entitle the
Member to a Eligible Room Night nor Points. Stay at a Participating redeemed partially in
Points and cash, only the portion of the Qualifying Room Rate paid by the Member in cash,
will entitle the Member to Points.

The Company reserves the right to reject any redemption or claim for reward that has been
tampered with, or found unacceptable, or not used in accordance with these terms and
conditions.
I. ANTI-BRIBERY AND CORRUPTION
Each Member hereby covenants, agrees and undertakes not to do anything which would be considered
as an offence of giving or receiving or abetting the giving and/or receiving of
‘gratification’ under the Malaysian Anti-Corruption Commission Act 2009 (MACCA), as
may be amended from time to time, which in practice means offering, giving, receiving or
soliciting something of value in an attempt to illicitly influence the decisions or actions of
an employee and/or a person who is in a position of trust within the Company. In the event of
breach of this clause, the Company is entitled to immediately terminate the Member’s
Membership, de-activate his/her account and forfeit all accrued benefits thereto (if any).
J. GOVERNING LAW
These terms and conditions are governed under the laws of Malaysia and the Company and Member
agrees to submit to the non-exclusive jurisdiction of the Malaysian courts.
